1. Who we are and definitions

These Terms and Conditions of Sale (the “Terms”) apply to every order placed on karinejeff.co.uk. The website is operated by Le Bonheur est dans le Pot SARL, trading as Karine & Jeff, a private limited company registered in France (Toulouse Trade and Companies Register no. 484 592 407), share capital €131,285, registered office Allée Nicolas Appert, Z.I. de la Pomme, 31250 Revel, France, EU VAT no. FR15484592407 (“we”, “us”, “our”).

  • “Website”: karinejeff.co.uk and all its pages.
  • “Products”: the goods offered for sale on the Website.
  • “Customer” or “you”: the person placing an order on the Website.
  • “Consumer”: an individual acting for purposes wholly or mainly outside their trade, business, craft or profession, within the meaning of the Consumer Rights Act 2015.

Please read these Terms carefully and keep a copy (print or save them) before placing an order. They are available at any time on this page.

2. Scope of these Terms

The Website sells meat-free and fish-free cooked dishes, soups and grocery products in glass jars. These Terms apply to the Products ordered on the Website and delivered in the United Kingdom. We may update these Terms by publishing a new version on the Website; the version that applies to your order is the one in force on the day you place it.

By placing an order, you confirm that you have read and accepted these Terms, together with our Terms of Use, our Privacy Policy and our Legal Notice. You must be 18 or over to place an order, or have the permission of a parent or guardian.

3. Your account

You can order as a guest or create a customer account. If you create an account, you agree to give accurate information (name, email address, delivery address, telephone number) and to keep it up to date. You are responsible for keeping your password confidential; we cannot be held responsible for access to your account resulting from the disclosure of your password. If you forget it, you can reset it at any time.

Your account lets you view your orders and manage your addresses. You can close your account at any time by emailing us. We may close an account that has provided deliberately false information or breached these Terms, or that has been inactive for more than one year.

4. Placing an order

The Products offered are those shown on the Website, while stocks last. Product photos are as faithful as possible, but the packaging or appearance of a Product may vary slightly from the photos.

To order, add the Products you want to your basket, then go to checkout. Before paying, a summary shows the Products, their quantities, their prices, the delivery charge and the total amount. You can correct any errors or change your order at any time before confirming payment.

After payment, we send you an email acknowledging your order. The contract between you and us is formed when we send that order confirmation email. If we cannot accept your order (for example if a Product is out of stock or there is an obvious pricing error), we will tell you and will not charge you, or will refund you in full.

The Products remain our property until we have received full payment.

5. Prices and payment

Prices are shown in pounds sterling (GBP) and include VAT at the rate applicable on the day of your order. Delivery charges are added at checkout and shown before you pay.

Import duties and charges. Your order is shipped from France. Any customs duties, import taxes and customs clearance fees charged on entry into the United Kingdom are not included in our prices or delivery charges and are payable by you, as the importer of the Products. The carrier (DHL) will contact you to collect them before delivery. We cannot tell you their exact amount in advance, as it is set by the UK authorities and the carrier.

We may change our prices at any time, but the price shown on the Website when you place your order is the price you pay. If we discover an obvious error in the price of a Product you have ordered, we will contact you before dispatch and you may either confirm the order at the correct price or cancel it for a full refund.

Payment is taken by debit or credit card when you place your order, through our secure payment provider (Stripe). We never see or store your full card details.

We keep order records and invoices on a durable medium; these records are evidence of the communications, orders and payments between us.

6. Delivery

We deliver to addresses in the United Kingdom. Import duties and charges are payable by you (see article 5). For the Channel Islands, the Isle of Man or any other destination, please contact us before ordering. Delivery charges and estimated delivery times are set out in our Shipping Policy and shown before payment.

Unless another date is agreed with you, we will deliver your order within 30 days of the contract being formed. The Products are your responsibility from the time they are delivered to you or to a person you have named.

Please check your parcel on delivery. If it is visibly damaged, you may refuse it or note your reservations with the carrier, and in all cases let us know as soon as possible (ideally within 48 hours) with a photo, so that we can replace or refund the Products concerned at our expense.

If a parcel is returned to us because it could not be delivered through your fault (incorrect address, parcel refused in error or import charges not paid, not collected), we will contact you: we can send it again once you have paid the new delivery charge, even if the original delivery was free.

If we do not deliver within the agreed period or, failing that, within 30 days, and delivery within that period was essential, you may treat the contract as at an end; otherwise you may give us a reasonable further period, after which you may treat the contract as at an end. We will then refund all sums paid within 14 days. This does not apply to delays caused by events outside our control.

7. Your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, as a Consumer you generally have the right to cancel your order within 14 days of the day after you receive the Products, without giving a reason.

Exceptions. This right does not apply to goods that are liable to deteriorate or expire rapidly (such as our chilled soups), or to sealed goods that are not suitable for return for health protection or hygiene reasons once they have been unsealed after delivery (for example an opened jar).

To cancel, tell us clearly before the 14-day period ends, by email or post (you may use the model form below), then return the unopened Products within 14 days of telling us. Unless the Products are faulty or not as described, you pay the cost of returning them; we recommend a tracked service. We will refund the price of the Products and the standard delivery charge you paid within 14 days of receiving them back (or of receiving proof that you have sent them back, if earlier), using the payment method you used for the order. We may reduce the refund if the value of the Products has been reduced by handling beyond what is necessary to establish their nature and characteristics.

8. Your statutory rights: quality of our Products

Under the Consumer Rights Act 2015, the Products must be as described, fit for purpose and of satisfactory quality. If they are not, you are entitled to:

  • reject them and get a full refund within 30 days of delivery, or, for perishable goods, within the period they could reasonably be expected to last;
  • after that period, a repair or replacement, and if that is impossible or fails, a price reduction or a refund;
  • a fault that appears within six months of delivery is presumed to have existed at delivery, unless this is incompatible with the nature of the goods (for example a Product used after its best-before or use-by date).

You may bring a claim for up to six years after delivery (five years in Scotland). To use these rights, contact our customer service (article 9), ideally with a photo of the Product and its batch number. Return costs, where a return is needed, are paid by us. This is a summary of your key legal rights; for detailed information visit the Citizens Advice website (citizensadvice.org.uk). Our Promise is in addition to these rights and does not affect them.

9. Customer service

10. Our responsibility

We are responsible to you for foreseeable loss and damage caused by us breaching these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, nor for events outside our reasonable control (force majeure). As our Products are sold for private use, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights as a Consumer.

Please always read the label of the Product (ingredients, allergens, storage instructions and dates) before eating it.

11. Intellectual property

All content of the Website (texts, photographs, logos, trade marks, videos) belongs to us or to third parties who have authorised us to use it. Any reproduction, representation or adaptation without our prior written consent is prohibited and may constitute an infringement of copyright or trade mark rights. 12. General

If a court finds part of these Terms unlawful, the rest will continue in force. These Terms are personal to you and you may not transfer them to anyone else. These Terms and all communications relating to them are in English.

13. Governing law and disputes

These Terms are governed by the law of England and Wales. You can bring legal proceedings in respect of the Products in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring proceedings in the courts of Scotland or Northern Ireland respectively. As a Consumer, you benefit from any mandatory provisions of the law of the part of the United Kingdom where you live.

If you have a complaint, please contact our customer service first: we will do our best to find an amicable solution quickly. We are not obliged to use an alternative dispute resolution (ADR) provider and do not currently do so. Asking us for an amicable settlement does not affect the time limits for bringing legal proceedings.
